Hire Agreement

This agreement is a contract between the member and Susanne Catherine Gallpen and Sarah Ann Lygo Gallpen trading as Grog on Wheels whose postal address is GPO Box 11055, Adelaide SA 5001 (“Grog on Wheels”).

The hire period commences from the time the hire equipment set out in the Delivery Sheet attached is delivered by Grog on Wheels to the delivery address and ceases at the time all components of the hire equipment are collected by Grog on Wheels on the day and at any time within the timeframe nominated by the member at the time of ordering. This period may vary and may incur an extra cost to the member as set out below.

If the delivery driver attends the delivery address on the day and at any time within the selected timeframe and the member is not in attendance, the driver will not leave the hire equipment. No refund will be given for the hire equipment. A Customer Care Officer from Grog on Wheels will contact the member to arrange a new delivery timeframe and a redelivery fee may be charged to the member’s credit card as detailed below.

Large hire items including cocktail and chocolate machines, chiller fridges, milkshake machines and coffee urns must be placed on a sturdy table or surface and should be located near a power point to avoid extension cords. Cords should never be placed across doorways or walkways where people may trip and injure themselves or damage the hire equipment.

All items are checked prior to the time of delivery and if you wish the driver to set up the hire equipment they will ensure that any electrical items are working at that time.

If any hire equipment has a defect, doesn’t do what it is supposed to do, was hired for a particular purpose on our advice and doesn’t do what we said it would do or doesn’t match the description or sample we gave you, we will provide you with a full refund, or if you wish, replacement hire equipment. However, we are not responsible for a fault or defect or damage to the goods, if you knew of the fault or defect or damage at the time of hire and/or hire delivery and accepted the hire equipment in that condition. You will not be entitled to a refund if you simply change your mind about the hire equipment or how much or what type you have hired or you discover that the hire equipment can be hired cheaper elsewhere.

If any hire equipment malfunctions the member should contact Grog on Wheels immediately on 1300 654 421 and replacement equipment will be provided if available. If replacement equipment is not available the total hire cost will be refunded to the member’s credit card detailed below provided the malfunction was not caused by the member or a third party after delivery of the hire equipment. However, if the malfunction was caused by the member or a third party, the member will be charged for a separate delivery fee for the replacement hire equipment and charged for the repairs or replacement of the original hire equipment.

The member acknowledges receipt of the hire equipment set out in the Delivery Sheet attached and agrees that the member:

  1. has inspected the hire equipment and considers it to be in good order and condition;

  2. has understood the method of operation of the hire equipment and will not try to avoid liability for damage on the grounds of not being familiar with operational procedures;

  3. will ensure that if the hire equipment is used by a third party that they are instructed in the method of operation of the hire equipment;

  4. will take full responsibility and liability for any damage to any hire equipment whilst in the member’s care and control;

  5. will take full responsibility and liability for any damage caused by a third party who has operated the hire equipment with or without the member’s consent;

  6. authorises Grog on Wheels to process a payment up to the current market value of the hire equipment from the credit card detailed below if the hire equipment is damaged, destroyed or stolen during the hire period;

  7. undertakes to make all components of the hire equipment available for collection on the day and at any time within the timeframe nominated by the member at the time of ordering;

  8. undertakes to make the hire equipment available for collection in good condition, undamaged and operational;

  9. if all components of the hire equipment are not available for collection on the day and at any time within the timeframe nominated by the member at the time of placing the order and/or the driver is unable to collect the hire equipment, authorises Grog on Wheels to process further daily payments from the member’s credit card detailed below (at the same rate as the original prices contained in the website at the time of placing the order) to hire the outstanding hire equipment until all components of the hire equipment are available for collection;

  10. acknowledges that the member has already paid a $50.00 Refundable Security Bond to Grog on Wheels and authorises that this bond be used in the first instance to pay for any redelivery / recollection fees, breakages, loss, damage or additional hire fees incurred in relation to the hire equipment including breakages, loss and damage in relation to items which have not incurred a hire fee. The balance of the Refundable Security Bond will be refunded to the member’s credit card detailed below;

  11. authorises that any further amounts incurred due to redelivery / recollection fees, breakages, loss, damage or additional hire fees in relation to the hire equipment (including breakages, loss and damage in relation to complementary items which have not incurred a hire fee) due to Grog on Wheels be debited from the member’s credit card detailed below;

  12. is the authorised signatory on the credit card detailed below.
